TERMS AND CONDITION

  1. All services and materials provided under this Scheme are intended for the use of research investigators in their own research in non-profit institutions. They may be provided subject to the conformity with specific restrictions or conditions.
  2. Each research investigator must register as a "user" of the UK Centre for Functional Genomics in Farm Animals ( ARK-Genomics ) individually in their own name. Registrations must not be shared.
  3. Approval should be sought from ARK-Genomics for any secondary distribution of materials or the use of services or materials, directly or indirectly, for commercial purposes. This requirement is not intended to inhibit patenting or commercial exploitation. Requests must be directed to the Administrator.
  4. In exchange for the supply of materials and services under this scheme, you may be asked to make available to other ARK-Genomics users, through ARK-Genomics , materials or data. The terms on which that might be done will be for negotiation in each case.
  5. Any publications arising from the use of materials or services provided under this scheme must acknowledge support received from ARK-Genomics and, where appropriate, refer to the originator of the materials.
  6. The Roslin Institute, acting through ARK-Genomics , will use reasonable care in the provision of services and materials. However, they are provided without any warranty, expressed or implied, of merchantability or fitness for any purpose. Any information and data relating to services and materials are provided without any warranty as to their accuracy or completeness. Biological materials obtained from ARK-Genomics must not be used for clinical or therapeutic use or as clinical diagnostics.
  7. The Roslin Institute, and its employees and agents, assume no responsibility or liability for consequential loss, damage or injury, and the recipient institution agrees to indemnify the Institute from, and against, any liability or claim arising from any provision to the recipient.
  8. Registration as a "user" may be terminated on account of misuse of the scheme or for failure or refusal to comply with the Terms and Conditions . We require that you do not use this facility to carry out any unlawful acts including contravention of the UK Data Protection Act 1998, part of which requires that you do not store any data (on ARK-Genomics systems) which relate to a living individual who can be identified from those data.
  9. Information given on this form will be used to setup a database for internal administration purposes.
  10. We will respect your email privacy. You will not receive unsolicited mail from ARK-Genomics and/or from third parties screened by ARK-Genomics unless you have agreed to this. We will, however, mail you occasionally with information about your registration.
    We will not pass on any individual user details (including your email address) unless we have your prior consent.
    Should we elect to change our privacy policy we will post the changes here. Where the changes are significant, we may also choose to email all our registered users with the new details.
  11. By completing this form, you give us permission to make backup copies of your data and information for the purpose of running the service.
  12. We require that you abide by the Acceptable Use requirements of JANET when using the computing facility (see http://www.ja.net/services/publications/policy/aup.html).
  13. The user's Institution accepts responsibility for any debts incurred by the user.
